the possibility of such damages. In no event will AST@NET's liability
for damages to you or any other person ever exceed the lower of
the list price or the actual price paid for the package or service,
regardless of the form of the claim. AST@NET is also not liable for
services provided by AST@NET, like sizings or technical architectures.
Sizings
Sizings are no science and are based on numerous testings and benchmarks on
different hardware platforms, operating systems testing different web servers,
application servers and/or databases. To many factors influence the performance
and the response time of a web architecture. That's why AST@NET can not guarantee
for the architecture recommended based on the sizing. Our sizings are usually very
accurate and in most of the sizings the numbers and the architecture proposed met
the customers requirements.
Quality of Video Conversion
The quality of a converted tape, CD or DVD depends on the quality of it's origin. AST@NET
can not guarantee a 100% quality compared to the original tape, CD or DVD, but it is
in our interest to convert video tapes, CDs or DVDs as good as possible. Due to the video
machines and the computer we use for the conversion a little loss in quality is mostly
inevitable. Should the quality of the video or audio part of the converted tape, CD or DVD
be under 50% we don't charge for the conversion and send you the converted tape, CD or DVD free of charge.
The quality judgement is exclusively reserved to AST@NET.
AST@NET can not be held responsible for loss of video or audio quality while shipping.
This responsibility pass to you upon our delivery to the carrier.
Risk of loss
All services and items purchased from AST@NET are made pursuant to a shipment contract.
This means that the risk of loss and title for such items pass to you upon our delivery
to the carrier.
Copyright for video conversion
The customer assures that the video material he/she sends for video conversion or copy
does not violate any copyright
laws in any country, or he/she has a permission from the video company that explicitly
allows video conversion or copy.
The customer also assures that the use of the converted or copied video material is for
home and private use only.
Right to Reject
AST@NET reserves the right to reject any media that is suspicious of containing unlawful
content. We will send the media back on the customer's cost.
